I/We__________________________________________________________________________(hereinafter referred to as OWNER) have voluntarily employed SARAH MCMURDO from Paws Forward Professional Dog Training to assist me in the training of my dog ____________________ (hereinafter referred to as THE DOG).
1. DESCRIPTION OF SERVICE:
Boarding
A current description of each training program may be attached to this Agreement and is available online at www.pawsforwardlondon.com. OWNER has read the attachment, and understands and agrees to the scope, detail, and limitations of the selected training program(s).
1.OWNER acknowledges that training may be an activity in which damage or injury to THE DOG and/or persons may occur. OWNER further acknowledges that THE DOG may be exposed to a variety of environmental conditions which include, but are not limited to, vehicular travel, interaction with people and other animals, exposure to adverse weather, and exposure to areas with crowds and all types of traffic.
2. FEE: The Fee for the selected program(s) is $50 per night. OWNER agrees to pay the deposit if required to SARAH MCMURDO to starts the selected training program(s) or to hold spot for boarding.
3. REFUNDS: Paws Forward Professional Dog Training does not refund deposits, but provides credit to OWNER for any unused portion of the selected program(s). The credit is transferable to another dog.
4. BOARDING AND DAY TRAIN PROGRAM REQUIREMENTS:
Before the Board and Train or Day Train phase of the selected training program(s) starts, OWNER agrees that dog is healthy and will provide written proof (if requested) of the following health standards to Paws Forward Professional Dog Training. - Rabies Vaccination - DA2PP (Distemper/Parvo) Vaccination - Bordetella Vaccine - Titer test for the 3 named vaccinations - Current Flea and Tick preventative.
For the duration of the Board and Train phase of the selected training program(s), OWNER agrees to provide Paws Forward Professional Dog Training with THE DOG’S food. This is required for the health and comfort of THE DOG. OWNER is responsible for any and all vet care that THE DOG should require at any time during its Board and Train stay. Paws Forward Professional Dog Training will do our best to contact THE OWNER should an emergency arise but we will go straight to the closest vet if the dog requires emergency care that we feel should not wait. By signing this agreement OWNER provides Paws Forward with consent to obtain medical care from the closest veterinary hospital at a value up to $2000 which the owner will be responsible for.
5. OWNER PERFORMANCE: OWNER understands that a successful dog training program depends on a combination of learned skills on the part of both the OWNER and THE DOG. OWNER understands that THE DOG’s behavior is not static, that THE DOG will NOT continue to perform even trained behaviors without ongoing practice. Especially in cases involving any type of aggression, OWNER understands THE DOG is never considered “cured”, although behavior may be modified.
OWNER agrees to comply 100% with the following Paws Forward Professional Dog Training requirements for the life of THE DOG:
• Implement the protocols and practices with THE DOG, which are described in the Printed Training Materials. • During the selected training program(s) practice the commands and lessons as instructed. • Make obedience a way of life for THE DOG. Practice ALL commands with THE DOG anywhere, everywhere, anytime.
6. LIFETIME COMMAND GUARANTEE: Although Paws Forward Professional Dog Training cannot guarantee, beyond any doubt, that THE DOG will respond to all commands at all times—this can only be guaranteed by the OWNER’s diligence with THE DOG—Paws Forward Professional Dog Training does guarantee that training will be completed to OWNER’S satisfaction, in accordance with the provisions of this Agreement. Further, if OWNER complies with the OWNER Performance requirements in this Agreement, THE DOG is healthy, and THE DOG forgets a command it was trained to do, Paws Forward Professional Dog Training will train THE DOG that forgotten command.
7. LIABILITY: OWNER agrees THE DOG’s behavior is ultimately OWNER’s responsibility.
Paws Forward Professional Dog Training agrees to train THE DOG in a reasonable manner. However, the effectiveness of the completed training program(s) depends upon many factors over which Paws Forward Professional Dog Training has no control. Such factors include, but are not limited to the future health of THE DOG, the frequency and effectiveness of training reinforcement OWNER must give THE DOG, and the degree of respect OWNER instills in THE DOG.
Although Paws Forward Professional Dog Training will use all reasonable care to train THE DOG, Paws Forward Professional Dog Training cannot guarantee that OWNER will ensure that THE DOG will respond adequately to commands at all times. OWNER agrees that Paws Forward Professional Dog Training will not be liable for any damage or loss resulting from THE DOG’s failure to respond to any command(s) or behavior modification for which Paws Forward Professional Dog Training trained THE DOG.
If THE DOG injures any person, or if THE DOG’s failure to respond to any commands(s) result in damage to any property or any person (including the OWNER), OWNER agrees to absolve Paws Forward Professional Dog Training from any and all obligations and to pay any such damage to such person. OWNER further agrees to forever hold Paws Forward Professional Dog Training harmless from any and all such claims.
8. MONETARY VALUE OF SERVICES AND/OR BONUSES: Bonuses, as applicable, including, but not limited to, Group Socialization Events, Email and Phone Support, etc., are gifts from Paws Forward Professional Dog Training as part of the selected training programs(s) and cannot be traded for any monetary value. If OWNER declines or does not use these bonuses, OWNER agrees not to request the monetary value of the bonus from Paws Forward Professional Dog Training. Paws Forward Professional Dog Training does not guarantee that space is available at all times in every Group Socialization Events; space is available on a first come first served basis.
9. INTELLECTUAL PROPERTY: The Printed Training Materials provided by Paws Forward Professional Dog Training is INTELLECTUAL PROPERTY protected under all applicable Copyright Law. OWNER acknowledges that OWNER has paid for the INTELLECTUAL PROPERTY. OWNER agrees to not copy, distribute or convey to any party by any means any Paws Forward Professional Dog Training INTELLECTUAL PROPERTY.
10. MISCELLANEOUS:
The failure of either party to enforce its rights under this Agreement at any time for any period shall not be construed as a waiver of such rights.
If any part, term or provision of this Agreement is held to be illegal or unenforceable, neither the validity nor enforceability of the remainder of this Agreement shall be affected.
Neither Party shall assign or transfer all or any part of its rights under this Agreement without the consent of the other Party.
This Agreement may not be amended for any other reason without the prior written agreement of both Parties.
Neither Party shall be liable for failure to perform or delay in performing any obligation under this Agreement if the failure or delay is caused by any circumstances beyond its reasonable control, including but not limited to acts of god, war, civil commotion or industrial dispute.
This Agreement shall be governed by the laws of the Province of Ontario.
11. DISPUTES: OWNER and Paws Forward Professional Dog Training hereby agree to mediate and/or arbitrate any misunderstanding that may arise pursuant to the terms contained herein. In any action or proceeding arising out of this Agreement, the prevailing party shall be entitled to reimbursement of costs and legal fees.
12. ENTIRE AGREEMENT: This Training Services Agreement contains the entire Agreement made between OWNER and Paws Forward Professional Dog Training, and there are no other promises or conditions in any other Agreement whether oral or written. This Training Services Agreement supersedes all other Agreements, written or oral, previously made between OWNER Sarah McMurdo AND Paws Forward Professional Dog Training.
